⚠️ 1. FITNESS & MEDICAL INJURY DISCLAIMER (IMPORTANT)
AlphaLift is a software application designed solely for workout logging, training organization, and athletic progression tracking. AlphaLift does NOT provide medical advice, physical therapy, medical diagnosis, or personalized medical care.
Weightlifting, resistance training, and progressive overload carry inherent risks of severe physical injury or cardiovascular complications. You must consult a licensed physician or healthcare professional before starting or changing any exercise routine. You participate in all physical training activities entirely at your own risk and responsibility.
2. Acceptance of Terms & Operating Entity
These Terms of Service and End User License Agreement ("Agreement") constitute a legally binding agreement between you and Easley Ventures LLC ("Company", "we", "us", or "our"), governing your access to and use of the AlphaLift mobile application, website, and related cloud services (collectively, the "Application").
By downloading, installing, accessing, or subscribing to AlphaLift through the Apple App Store, Google Play Store, or our web portals, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the Application.
💳 3. Subscriptions & Billing Disclosures (Apple StoreKit & Google Play)
AlphaLift provides a powerful free tier as well as optional auto-renewing premium subscription options ("AlphaLift Pro") providing access to advanced volume analytics, unlimited routines, cloud sync, and muscle heatmaps:
- AlphaLift Pro Monthly: Auto-renewing subscription billed monthly at $4.99 per month.
- AlphaLift Pro Annual: Auto-renewing subscription billed annually at $29.99 per year (includes a 7-day free trial where offered).
- AlphaLift Lifetime Pass: One-time non-consumable in-app purchase of $69.99 for permanent, perpetual access with no recurring charges.
Payment: Payment will be charged to your Apple ID Account (for iOS users) or Google Play Account (for Android users) at confirmation of purchase.
Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-applicable renewal rate ($4.99/mo or $29.99/yr).
Managing & Canceling Subscriptions: Subscriptions may be managed by the user and auto-renewal may be turned off at any time by going to your Account Settings on the App Store (iOS) or Subscriptions in Google Play Store (Android) after purchase.
Free Trial Terms: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
Refunds: All payments and refunds are handled directly by Apple or Google under their respective terms of service. Easley Ventures LLC cannot directly issue refunds for purchases completed through the App Store or Google Play.
4. Apple Licensed Application End User License Agreement (EULA)
For users who download the Application from the Apple App Store, this Agreement supplements and incorporates the terms of the Apple Standard Licensed Application End User License Agreement (Standard EULA).
You acknowledge that this Agreement is concluded between you and Easley Ventures LLC only, and not with Apple Inc. Easley Ventures LLC is solely responsible for the Application and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
5. Intellectual Property Rights
All right, title, and interest in and to AlphaLift—including but not limited to source code, user interfaces, graphic designs, algorithms (including the progressive overload formulas and muscle fatigue models), sound assets, and trademarks—are owned exclusively by Easley Ventures LLC. You are granted a limited, personal, non-exclusive, non-transferable license to use the app for personal, non-commercial fitness tracking.
6. Account Termination & Deletion
You may terminate your account at any time directly through the app via Settings → Account → Delete Account or by contacting our support team. We reserve the right to suspend or terminate accounts that breach these Terms, attempt unauthorized access to our APIs, or engage in security tampering.
7. Limitation of Liability & Warranty Disclaimer
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASLEY VENTURES LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION PHYSICAL INJURY, HEALTH CONDITIONS, LOSS OF DATA, OR GYM EQUIPMENT DAMAGE ARISING OUT OF YOUR USE OF THE APPLICATION.
8. Governing Law & Jurisdiction
These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
